    Huaihua Urban Management and Law Enforcement Bureau

    Huaihua Urban Management and Administrative Law Enforcement Bureau is a department of the People’s Government of Huaihua City, which was established as per the Implementation Opinions of the CPC Huaihua Municipal Committee and People’s Government of Huaihua City on the Function Transformation and Institutional Reform Plan of People’s Government of Huaihua City (H.F. [2015] No. 7) and Notice of the CPC Huaihua Municipal Committee and People’s Government of Huaihua City on the Institutions of the People’s Government of Huaihua City (H.W. [2015] No. 8).

    I. Responsibility Adjustment

    1. Matters subject to administrative review and approval

    Cancel, delegate, adjust and add matters subject to administrative review and approval announced by the People’s Government of Huaihua City for change.

    2. Integrated responsibilities

    (1) Integrate the responsibilities of the former Huaihua Urban Management and Administrative Law Enforcement Bureau and the former Huaihua Public Utilities Administration.

    (2) Transfer the administrative functions of the former Huaihua Garden Management Office.

    (3) New responsibilities to support the development of the “smart Huaihua” digital city platform, and lead the establishment of the digital urban management system.

    (4) Transfer the power of administrative penalty prescribed by laws, regulations and rules on urban public passenger transport management of Huaihua Urban Management and Administrative Law Enforcement Bureau to Huaihua Traffic and Transportation Bureau.

    (5) Transfer the power of administrative penalty prescribed by laws, regulations and rules on urban planning management of Huaihua Urban Management and Administrative Law Enforcement Bureau over construction projects launched in city planning areas without the Permit for Planned Land Use and Permit for Planned Construction Project to Hecheng District.


    II. Main Responsibilities

    The main responsibilities of Huaihua Urban Management and Law Enforcement Bureau (“the Bureau” hereinafter) are as follows:

    1. The Bureau shall implement national, provincial and municipal laws, regulations and policies on urban management and administrative law enforcement. It shall also formulate and adopt medium- and long-term plans as well as annual work plans for sanitation, landscaping, water supply and drainage, sewage treatment, outdoor advertising, parks, urban lighting facilities, centralized disposal of urban waste, municipal infrastructure management maintenance, etc.

    2. The Bureau shall be responsible for the organization, leadership, coordination, assessment, supervision and performance evaluation of urban management and administrative law enforcement efforts. It shall also guide urban management and administrative law enforcement work, and undertake the administrative review of urban management and administrative law enforcement cases in county-level cities and districts.

    3. The Bureau shall establish and manage the “smart Huaihua” digital urban management platform, and guide digital urban management work in county-level cities and districts.

    4. The Bureau shall be responsible for the centralized disposal of urban household waste and management of garbage disposal sites.

    5. The Bureau shall be responsible for the management, law enforcement and maintenance of municipal public facilities, municipal roads, street lamps, urban bridges and culverts, and urban drainage systems transferred to Huaihua City (excluding those within the jurisdiction of Hecheng District and Huaihua Economic Development Zone); undertake the general renovation and expansion of municipal infrastructure; undertake the temporary occupation and excavation management of the city’s main and secondary roads (including sidewalks) due to actual and maintenance needs, supervise the urban underground pipe network facilities, prepare plans for municipal facilities, and participate in the final acceptance of municipal works.

    6. The Bureau shall manage the gardens, landscaping work, scenic spots and parks in city planning areas whose jurisdiction has been transferred to Huaihua City (excluding those within the jurisdiction of Hecheng District and Huaihua Economic Development Zone); manage and maintain sculptures in urban areas; protect the ancient and famous trees in urban areas, and review and approve the transplant of such trees; protect the biodiversity in city planning areas; and implement national standards and codes of practice for the urban landscaping industry.

    7. The Bureau shall be responsible for the management and law enforcement of water supply (including secondary water supply), planned water use and water conservation in city planning areas; issue the urban drainage permit; monitor the water quality of urban water supply enterprises, give relevant guidance, and manage urban sewage treatment.

    8. The Bureau shall be responsible for outdoor advertising and law enforcement within the municipal jurisdiction.

    9. The Bureau shall be responsible for urban management and comprehensive law enforcement in city planning areas. Its functions and powers are as follows:

    (1) Administrative punishment powers provided by laws, regulations and rules on municipal management.

    (2) Administrative punishment powers provided by laws, regulations and rules on urban landscaping management.

    (3) Certain administrative punishment powers provided by laws, regulations and rules on environmental protection.

    (4) Administrative punishment powers provided by laws, regulations and rules on outdoor advertising.

    10. The Bureau shall establish an information system and assessment mechanism for the investigation and handling of illegal buildings in city planning areas, and guide, supervise and coordinate the investigation and handling of such buildings.

    11. The Bureau shall formulate the annual plan for the use of maintenance and management funds for municipal facilities and report such funds. It shall administer urban maintenance and construction funds and other special funds; inspect and supervise the use of funds; collect, manage and use various fees and relevant special funds according to its responsibilities, laws, regulations, rules and policies.

    12. The Bureau shall guide and promote technology application in the urban management industry, as well as the introduction and innovation of major technologies.

    13. The Bureau shall undertake other tasks assigned by the Huaihua Municipal Party Committee and People’s Government of Huaihua City.

    In addition, as per the Notice on Deepening Urban Administrative Law Enforcement and Reform of the Sanitation Management System (H.B. [2015] No. 46) issued by the General Office of the CPC Huaihua Municipal Committee and General Office of the People’s Government of Huaihua City, the Bureau shall, in line with the principles of “performing due responsibilities within the geographical jurisdiction, delegating power, and unifying responsibilities and powers”, delegate its management responsibilities for urban administrative law enforcement, sanitation, muck law enforcement, and regulation and demolition of illegal buildings to Hecheng District. Specifically, it shall: (1) delegate the urban management law enforcement and muck management functions to Hecheng District; (2) delegate powers over urban road cleaning, maintenance of sanitation facilities, cleaning and business order management of farmer’s markets, management of fireworks prohibited in urban areas, management of coal yards, decoration management of stores along streets and residential property, layout, access and assessment of time-limited night markets, street markets and stalls, and management of the urban sanitation accountability system for institutions, stores and households along streets to Hecheng District; (3) delegate the functions for the traffic order management of pedestrians and non-motor vehicles in urban areas to Hecheng District.
