    Huaihua Municipal Bureau of Natural Resources and Planning

    Huaihua Municipal Bureau of Natural Resources and Planning (“the Bureau” hereinafter) is a director-level department of the People’s Government of Huaihua City, which was formed by the former Huaihua Bureau of Land and Resources and Huaihua Planning Bureau. Its main responsibilities are as follows:

    1. The Bureau shall perform the duties as the owner of public natural resources including land, mineral, forest, grassland, wetland and water, as well as power over the utilization of national territory space in accordance with law; implement national and provincial laws, regulations, rules and technical specifications on urban and rural planning, and formulate regulatory documents on its management; draw up local laws, regulations and rules on land, mineral, water and other natural resources as well as national territory space planning, develop relevant policies, and supervise and inspect their implementation.

    2. The Bureau shall be responsible for surveying, monitoring and evaluating natural resources. It shall establish a unified and standard natural resources survey, monitoring and evaluation system in accordance with relevant national indicator system and statistical standards; carry out basic survey, special survey and monitoring of natural resources; supervise and manage the deliverables in the survey, monitoring and evaluation of natural resources and release relevant information; and guide counties and districts to carry out such work.

    3. The Bureau shall carry out unified registration for natural resources. It shall formulate rules, standards and specifications for the unified registration, title investigation, real estate surveying & mapping, dispute mediation and application of various natural resources and real estate; develop a sound basic platform for Huaihua’s natural resources and real estate registration information management; collect, sort, share and manage natural resources and real estate registration data; and guide and supervise the registration of natural resources and real estate across the city.

    4. The Bureau shall be responsible for the paid use of natural resources. It shall establish a statistical system for public natural resources and undertake the accounting of such resources; prepare the balance sheet of public natural resources and put forward assessment criteria; formulate policies on the allocation, transfer and lease of public natural resources and those evaluated as investment, as well as land reserve policies, and reasonably allocate such public natural resources; and undertake the value evaluation and management of natural resources.

    5. The Bureau shall be responsible for the rational exploitation and use of natural resources. It shall work out plans and strategies for the development of natural resources, formulate standards for the exploitation and use of natural resources and implement such standards, establish a system where the government will make the prices of natural resources public, carry out natural resources grading price evaluation and natural resources use evaluation and assessment, and give guidance on the economical and intensive use of natural resources; oversee the natural resources market; and study policies and measures related to macro-control, regional coordination and urban-rural coordination in natural resources management.

    6. The Bureau shall establish a spatial planning system and supervise its implementation. It shall advance the strategy and system of functional areas, develop plans on national territory space and relevant special plans, and supervise their execution; conduct suitability evaluation of national territory space development, and set up the monitoring, evaluation and early warning system for the implementation of national territory space plans; delimit the ecological protection boundaries, permanently protected farmland, urban development boundaries and other control lines, and form the production, living and ecological space layout featuring resources saving and environmental protection; develop and implement the sound system of national territory space utilization; undertake urban and rural planning management, formulate relevant policies and supervise their implementation; draw up and implement the annual plans for the utilization of land and other natural resources; and undertake work related to the use conversion of land and other national territory space, as well as the administration of land expropriation.

    7. The Bureau shall coordinate the ecological restoration of national territory space. It shall lead the formulation of corresponding plans and implement relevant major projects; undertake the comprehensive improvement of national territory space, land consolidation and reclamation, and restoration and management of the geological environment of mines; lead the establishment and implementation of the ecological compensation system, formulate policies and measures for the rational use of social funds in ecological restoration, and propose major municipal alternative projects.

    8. The Bureau shall implement the strictest farmland protection system. It shall lead the formulation and implementation of farmland protection policies, take charge of farmland conservation and ecological protection, and do a good job in protecting farmland quality; carry out farmland protection accountability evaluation and put permanently protected farmland under special protection; refine the farmland requisition-compensation balance system, and supervise the execution of the compensation system for land requisition.

    9. The Bureau shall be responsible for the management of the geological exploration industry and geological work across Huaihua City. It shall prepare the geological exploration plan and supervise its implementation; manage municipal geological exploration projects; implement major geological and mineral exploration projects; supervise and address geological problems such as land subsidence as a result of excessive exploitation of groundwater; and supervise and manage paleontological fossils.

    10. The Bureau shall prevent and control geological disasters. It shall implement relevant requirements of comprehensive disaster prevention and reduction plans, work out the geological disaster prevention plans and protection standards, and guide their implementation; direct, coordinate and supervise geological disaster investigation and evaluation, as well as the general investigation, detailed investigation and identification of potential risks; guide and perform mass prediction and prevention, professional monitoring, forecasting, early warning, as well as geological disaster treatment; and provide technical support for emergency rescue in geological disasters.

    11. The Bureau shall be responsible for the management of mineral resources. It shall undertake the management of mineral resource reserves and review & approval of mineral resources overlaid by construction projects; manage mining rights; work with other departments concerned to regulate and manage specific minerals and advantageous minerals subject to protective mining; and supervise and guide the rational utilization and protection of mineral resources.

    12. The Bureau shall be responsible for the management of surveying, mapping and geoinformation. It shall manage basic surveying & mapping, as well as the surveying & mapping industry; undertake surveying & mapping qualification and credit management, and supervise and manage geographic information security and market order; guide work related to the development of information-based urban and rural planning and its display, and establish the planning geographic information system; undertake map management and geographic information public services; protect survey beacons; collect and share city-wide geospatial data; and acquire, process and provide aerospace remote sensing image data in a unified manner.

    13. The Bureau shall advance technological development in natural resources and planning. It shall formulate and implement plans for technological innovation and development as well as talent training in natural resources and planning; draw up technical standards, procedures and specifications and supervise their execution; implement major technological projects and innovation capacity building, and boost the development of information-based natural resources and planning, as well as public services for information and data; seek international cooperation and exchanges in natural resources, and work out and implement natural resources policies for external cooperation.  

    14. The Bureau shall, as authorized by the Huaihua Municipal Party Committee, supervise the implementation of major policies, decisions, plans, laws and regulations of the Huaihua Municipal Party Committee and the People’s Government of Huaihua City on natural resources and national territory space planning by governments and relevant departments below the municipal level; investigate and handle major violations in the exploitation and utilization of natural resources, as well as planning, surveying and mapping of national territory space; and guide relevant administrative law enforcement.

    15. The Bureau shall study the overall urban planning and development strategy, put forward policy suggestions on coordinating urban and rural planning and fostering the building of a resource-saving and environment-friendly society, strengthen the leading role of urban and rural planning in economic and social development, and advance urban-rural integration; organize the review and approval of urban system plans, overall plans and detailed plans; work out and manage plans for municipal works; participate in the feasibility study of other major construction projects; and undertake the review, approval and supervision of historic cities in Huaihua.

    16. The Bureau shall select sites for construction projects in the city planning area, review the design schemes of planning and construction projects, manage construction land and project planning, and issue the Opinions on Site Selection of Construction Project, Permit for Planned Land Use and Permit for Planned Construction Project; participate in the feasibility study and preliminary design review of construction projects in the city planning area; supervise and manage municipal planning after approval; and participate in urban and rural survey and municipal work management.

    17. The Bureau shall be responsible for qualification management of the planning and design units, and guide the professional qualification management of urban planning.  

    18. The Bureau shall be responsible for guiding the preparation of the planning of Zhijiang Town, Luojiu Town, Gongping Town, Zhongfang Town, Pailou Town and Tongmu Town in the “One Body with Two Wings” planning area, undertake planning control, and supervise its implementation.

    19. The Bureau shall undertake the routine work of Huaihua Municipal Land Administration Commission and Huaihua Municipal Commission of Urban and Rural Planning.

    20. The Bureau shall put Huaihua Forestry Administration under centralized leadership and management.

    21. The Bureau shall complete other tasks assigned by the Huaihua Municipal Party Committee and People’s Government of Huaihua City.

    22. Function transformation. The Bureau shall implement the requirements of the CPC Central Committee on performing the duties as the owner of public natural resources, control over the utilization of national territory space and ecological protection and restoration in a unified way, strengthen top-level design, give play to the controlling role of national territory space planning, and provide science-based guidance for the protection, rational exploitation and utilization of natural resources. It shall bolster the protection, rational exploitation and utilization of natural resources, and develop a sound working mechanism that combines source protection and restoration and treatment over the whole process, in a bid to achieve overall protection, systematic restoration and comprehensive treatment. By innovating policies and measures that combine incentives and constraints, it shall advance the economical and intensive use of natural resources. The Bureau shall further streamline administrative approval matters and delegate power, step up supervision, give full play to the decisive role of the market in resource allocation, better play the role of the government, strengthen the binding effect of rules, standards and policies of natural resources management, and make natural resources registration and evaluation more convenient and efficient.
