    Huaihua Municipal Bureau of Water Resources

    Regulations on the Functions, Internal Institutions and Staffing of Water Resources Bureau of Huaihua

     Article 1 The Regulations on the Functions, Internal Institutions and Staffing of Water Resources Bureau of Huaihua (“the Regulations” hereinafter) is formulated as per the Notice of the General Office of the CPC Hunan Provincial Committee and General Office of the People’s Government of Hunan Province on Issuing the Huaihua Institutional Reform Plan (X.B. [2018] No. 65).

     Article 2 Water Resources Bureau of Huaihua (“the Bureau” hereinafter) is a director-level department of the People’s Government of Huaihua City.

    Article 3 The Bureau implements the guidelines, policies, decisions and plans of the CPC Central Committee, as well as the plans and requirements of the provincial and municipal Party committees on water conservancy. The Bureau upholds and strengthens the centralized and unified leadership of the Party over water conservancy during its duty performance. Its main responsibilities are as follows:  

    i. The Bureau shall ensure the rational development and utilization of water resources. It shall formulate policies and plans on water conservancy, relevant local laws, regulations and rules, and major water conservancy plans such as the municipal water resources plan, comprehensive plan of important river and lake basins determined by Huaihua City, as well as flood control plan.

     ii. The Bureau shall well coordinate and guarantee water supply for living, production and operation, and ecological environment. It shall enforce the strictest water resources management system, supervise and manage water resources in a unified way, formulate municipal and cross-regional medium- and long-term plans on water supply and demand as well as water allocation, and oversee their implementation; undertake the water resources scheduling of important basins and regions, as well as major water diversion projects; enforce the systems of licensing for water-taking, water resources argumentation and flood control demonstration, and guide work related to compensation for water use; and guide the water supply of the water conservancy industry, villages and towns.

     iii. The Bureau shall formulate and implement rules on the development and operation management of water conservancy projects in accordance with relevant regulations; give suggestions on the scale, direction and specific plans for fixed asset investment in water conservancy, and organize and guide their implementation; review and approve planned fixed asset investment projects and those included in the annual plan as authorized by the People’s Government of Huaihua City; advise on the allocation of water conservancy funds, and supervise and manage project implementation.  

     iv. The Bureau shall guide the protection of water resources. It shall develop and implement relevant plans, and guide work related to the protection of sources of drinking water, development and utilization of groundwater, and management and protection of groundwater resources.

     v. The Bureau shall be responsible for water conservation. It shall work out relevant policies and plans, supervise their execution, and formulate relevant standards; implement total water consumption control and other management systems, and guide and promote the building of a water-saving society.

     vi. The Bureau shall give guidance on the management, protection and comprehensive utilization of water conservancy facilities, waters and their shorelines; improvement, development and protection of rivers, lakes and estuaries; as well as water ecological protection and restoration, ecological flow and water volume management, and water system connection of rivers and lakes. It shall also undertake work related to the adoption of the river (lake) chief system.

     vii. The Bureau shall guide and supervise the construction and operation management of water conservancy projects. It shall guide the development and operation management of water conservancy infrastructure, and supervision and management of the water conservancy construction market. It shall also oversee the construction of water conservancy projects.

     viii. The Bureau shall have oversight of water and soil conservation. It shall formulate relevant plans and supervise their implementation; take comprehensive measures for water and soil loss control, monitor and forecast such loss, and make regular announcements. It shall also supervise and manage water and soil conservation in construction projects, and guide the implementation of key water and soil conservation construction projects.

    ix. The Bureau shall guide rural water conservancy work. It shall undertake the construction and reconstruction of large and medium irrigation and drainage projects. It shall also give guidance on the construction and management of projects that bring safe drinking water to rural areas, as well as work related to water-saving irrigation; reform and innovation of water conservancy, and building of a social service system in rural areas; and development of rural hydropower resources, transformation of small hydropower stations, and rural hydropower electrification.

     x. The Bureau shall be responsible for the management of resettlers from water conservancy projects. It shall develop relevant policies for resettlers from large and medium reservoir construction and supervise their execution, and implement systems for the resettlement, acceptance, supervision and evaluation of resettlers from water conservancy projects; guide and oversee the adoption of subsequent support policies for reservoir resettlers; and coordinate and bolster targeted support for such resettlers.

    xi. The Bureau shall guide and coordinate the investigation and handling of major water-related illegal activities, coordinate water disputes across counties and districts, and guide water administrative supervision and administrative law enforcement; have oversight of production safety in the water conservancy industry in accordance with law, and guide the safety supervision of reservoirs, dams of hydropower stations and other water conservancy project facilities.

     xii. The Bureau shall carry out work related to water conservancy technologies and foreign affairs; develop local technical standards, procedures and specifications for the water conservancy industry and supervise their implementation; and perform quality supervision of the water conservancy industry.

     xiii. The Bureau shall implement plans for comprehensive disaster prevention and mitigation, develop plans for preventing and controlling floods and droughts and relevant protection standards, and guide their implementation; formulate plans on flood and drought control and emergency water regulation for important rivers, lakes and water projects, submit the plans for approval according to the procedures, and implement such plans; provide technical support for flood prevention and emergency rescue; and undertake the scheduling of important water projects during typhoon defense.

     xiv. The Bureau shall complete other tasks assigned by the Huaihua Municipal Party Committee and People’s Government of Huaihua City.

     xv. Function transformation. The Bureau shall take solid steps to strengthen the rational utilization, optimal allocation, conservation and protection of water resources. With water conservation put on the top of the agenda, it shall shift its focus from increasing supply to managing demand, strictly control total water consumption, and improve water use efficiency. While giving priority to protection, the Bureau shall step up management and protection of water resources, waters and water conservancy projects, to make the rivers and lakes healthy and beautiful. The Bureau shall adopt a holistic approach to ensure water supply for rational water use, sustainable use of water resources, and water security in economic and social development.

    Article 4 The Bureau has the following internal institutions:

     i. Office (Retirees Management Service Division). It is responsible for the operation of the Bureau, work related to information, security, confidentiality, public complaints and proposals, transparency in government affairs, information-based government affairs, news and publicity, and retiree management services.

     ii. Water Conservancy Planning Technology & Construction Division. It shall formulate strategic plans on water conservancy, as well as comprehensive plans, specialized plans and special plans for major water conservancy projects; review the proposals, feasibility study reports and preliminary design of key water conservancy construction projects; organize and guide flood control demonstration; guide the compliance review of water conservancy construction projects; implement municipal water conservancy construction investment plans, and coordinate the supervision and management of project implementation; implement plans on the development of water conservancy technologies, formulate local technical standards, procedures and specifications of the water conservancy industry and supervise their adoption, and carry out research on major water conservancy projects, technology introduction and technology promotion; guide the construction and management of water conservancy projects, formulate and implement relevant rules; guide the development of such water conservancy infrastructure as reservoirs, sluices and embankments, as well as the reinforcement of important dangerous reservoirs (sluices) and important embankments; guide the appraisal and acceptance of water storage safety in water conservancy projects; guide the supervision and management of the water conservancy construction market and the establishment of its credit system; and undertake water conservancy statistical work.

     iii. Personnel & Finance Division. It shall have oversight of officials, staffing, education & training and labor wages of the Bureau and its affiliated institutions, and guide the training of water conservancy personnel; push forward with the reform of the water conservancy system; prepare and implement department budgets, and undertake financial management, asset management and internal audit; give suggestions on the allocation of municipal water conservancy financial funds, and coordinate performance evaluation of project implementation; advise on the prices, taxes, funds and credits of water conservancy; and put its administrative and institutional fees under unified management.

     iv. Water Resources, Policies & Regulations Division (Huaihua Water Conservation Office). It shall undertake work related to the implementation of the strictest water resources management system, adopt the systems of licensing for water-taking and water resources argumentation, and guide work related to compensation for water use; guide and supervise water allocation, and guide the management of ecological flow and water volume of rivers and lakes; prepare plans for water resources protection, and guide work related to the protection of drinking water sources; carry out water resources investigation and evaluation, monitor and give early-warning of their carrying capacity, and prepare and issue municipal water resources bulletins; formulate water conservation policies, develop water conservation plans and coordinate their implementation, and guide planned water use and water conservation; enforce the systems for total water consumption control, water use efficiency control, planned water use and quota management; guide and propel the building of a water-saving society; guide the development and utilization of unconventional water sources such as the treatment and reuse of urban wastewater; guide hydrological work; draft relevant local laws, regulations and rules, develop policies on water conservancy work, and supervise their implementation; handle matters concerning response to administrative litigation by the Bureau, administrative review and administrative compensation; guide water administrative supervision and law enforcement, coordinate water disputes across counties and districts, and investigate major water-related illegal activities.

     v. Water Conservancy Project Quality & Operation Safety Supervision Division (Floods & Droughts Prevention Division). It shall supervise the quality of water conservancy projects; guide the management, protection and comprehensive utilization of water conservancy facilities, develop the procedures for reservoir operation and scheduling, and guide the operation management and demarcation of reservoirs, dams of hydropower stations, embankments, sluices and other water conservancy projects; supervise and inspect the implementation of major water conservancy policies, decisions, plans and major tasks; implement safety supervision of water conservancy projects; guide the safe production of the water conservancy industry, as well as the safety supervision of reservoirs, dams of hydropower stations and other water conservancy projects; prepare and implement plans on flood and drought control and protection standards, as well as plans for preventing and controlling floods and droughts and emergency water regulation for important rivers, lakes and water projects; undertake the scheduling of important water projects during typhoon defense; evaluate the impact of flood in flood protection areas; analyze cross-regional water supply and demand, guide and supervise water resources scheduling; guide the preliminary work of large water diversion projects; and guide and oversee the scheduling and management of cross-regional and cross-basin water diversion projects.

     vi. River & Lake Management Division (River Chief System Division). It shall guide the management and protection of waters and their shorelines, development, treatment and protection of important rivers, lakes and estuaries, water ecological protection and restoration of rivers and lakes, and water system connection of rivers and lakes; supervise and manage river sand mining, guide the preparation of relevant plans, and adopt the review system for engineering construction plans within the scope of river management; undertake the routine work of the Office of Huaihua River Chief System Working Committee; formulate and implement rules, regulations, work plans and assessment plans for the municipal river (lake) chief system; supervise and implement tasks assigned by municipal river (lake) chiefs, coordinate member units of the Huaihua River Chief System Working Committee in the protection of rivers (lakes), and guide the operation of the local river (lake) chief system.

     vii. Water & Soil Conservation Division (Administrative Review & Approval Service Division). It shall be responsible for the comprehensive control on water and soil loss; develop plans on water and soil conservation and supervise their implementation; monitor and forecast water and soil loss and make announcements; review water and soil conservation plans for construction projects within its authority, and supervise their implementation. It shall also adopt the system for the collection and use of compensation fees for water and soil conservation; undertake the unified acceptance, registration and preliminary review of application materials of matters subject to administrative review and approval, as well as payment, production of certificates (documents), sealing, issuance of certificates (documents) and other services for the handling of relevant matters, and send staff to work at the Huaihua Government Service Center.  

    viii. Rural Water Conservancy & Hydropower Division (Reservoir Resettler Division). It shall undertake the construction and reconstruction of large and medium irrigation and drainage projects, and guide the development and management of projects that bring safe drinking water to rural areas; guide work related to water-saving irrigation; supervise and manage hydropower resources; formulate plans for the development of hydropower resources in rural areas, and guide hydropower electrification, transformation of hydropower stations for increased efficiency and capacity, establishment of small hydropower stations for electricity supply and other development work; and guide water conservancy reform and innovation, as well as the establishment of a social service system in rural areas. It shall manage resettlers from large and medium reservoir projects; review and implement plans for the resettlement of resettlers from large and medium water conservancy projects, as well as plans for follow-up support; undertake work related to the resettlement and follow-up support for such resettlers; and implement systems for the acceptance, supervision and evaluation of their resettlement. It shall also manage the funds for the resettlers, and coordinate and step up paired support for reservoir resettlers in Huaihua.

     Party Committee. It shall be responsible for work related to the Party and the people in the Bureau and its affiliated institutions.

    Article 5 The Bureau has 24 administrative budgeted posts. Specifically, the Bureau has one director, three deputy directors, and one chief engineer (temporary); nine posts for section-level leaders (including one full-time deputy secretary of the Party Committee), and five posts for deputy-section-level leaders. There are also two fully budgeted posts for logistics services, for which there shall be no new employees.

    Article 6 The establishment, duties and staffing of public institutions under the Bureau shall be otherwise stipulated.

    Article 7 The Regulations shall be interpreted by the Huaihua Municipal Party Committee and adjusted by the Huaihua Municipal Commission Office of Public Sectors Reform according to prescribed procedures.

    Article 8 The Regulations shall take effect upon its issuance.
