Notice from the People’s Government of Hecheng District of Huaihua on the Prohibition and Restriction of Fireworks and Firecrackers in the Urban Area

In accordance with the Law of the People’s Republic of China on the Prevention and Control of Atmospheric Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers, the Notice on the Guarding the Blue Sky Action Plan for Air Pollution Prevention and Control in Hunan Province (2023-2025), the Regulations on Comprehensive Urban Management of Hunan Province, and the Regulations on Urban Appearance and Environmental Sanitation Management of Huaihua City, the following notice is hereby issued regarding the prohibition and restriction of fireworks and firecrackers in the main urban area of Huaihua City:
I. Prohibited areas for fireworks and firecrackers: the main urban area of Huaihua City (east to the Municipal Party School, west to West Ring Road, south to Hukun High-speed Railway Line, and north to Yuechi Road); government offices, cultural heritage protection units, transportation hubs such as stations and docks, as well as safety protection zones of railway lines within the Huaihua Ring Expressway (including the International Land Port); areas within 100 meters of places for the production and storage of flammable and explosive hazardous materials; safety protection zones of energy facilities, including power transformation stations and gas stations; high-rise buildings using flammable external insulation materials and buildings with low fire resistance; primary and secondary schools, kindergartens, medical institutions, and nursing homes; public places with high population density such as shopping malls, supermarkets, and theaters; key fire prevention areas such as scenic spots, forests, green spaces, and nurseries; main and secondary roads and underground passages; other areas designated by the municipal and district governments as prohibited for fireworks and firecrackers.
II. Restricted Areas for Fireworks and Firecrackers: within the administrative jurisdiction of Hecheng District inside the Huaihua Ring Expressway (including the International Land Port), areas not designated as prohibited will be considered restricted for fireworks and firecrackers (east to Ring Expressway, west to Baomao Expressway, south to Ring Expressway, and north to Xuhai Expressway). Two designated fireworks and firecracker discharge sites will be established at: the square in front of the Huaihua Jiufeng Modern Agricultural Expo Park along the extended Lulin Road, and the south riverside road of the International Land Port Bridge. During the period from Lunar New Year’s Eve to the third day of the first month of the lunar calendar, as well as on the fifteenth day of the first lunar month and National Day (October 1), the discharge of fireworks and firecrackers is permitted; at all other times, such discharge is strictly prohibited.
III. Any individual who violates this notice by discharging fireworks and firecrackers will be ordered by the public security department to cease such activities and may face a fine ranging from 100 to 500 yuan, as stipulated in Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers. If the violation constitutes a public security offense, administrative penalties will be imposed according to the law. If fireworks and firecrackers are discharged in a manner that endangers public safety or personal and property safety, criminal liability shall be imposed in accordance with the law.
IV. Individuals who refuse or obstruct lawful enforcement actions during the investigation of illegal fireworks discharge will be punished by public security authorities in accordance with the Public Security Administration Punishment Law of the People’s Republic of China. Where such action constitutes a crime, criminal liability shall be imposed in accordance with the law.
V. During major celebrations and holidays, if a fireworks display or large-scale discharge event is planned, prior approval from the public security authorities must be obtained, and discharges must be conducted at designated locations in accordance with safety regulations. Unauthorized fireworks displays or large-scale discharge events will be halted by public security authorities, and responsible units will face fines ranging from 10,000 to 50,000 yuan as per the Regulations on the Safety Management of Fireworks and Firecrackers.
VI. Environmentally friendly, civilized, and safe celebrations are strongly advocated. Citizens are encouraged to actively stop and report violations of this notice regarding the discharge of fireworks and firecrackers. First informant of verified reports will be rewarded; those who retaliate against the informants will be punished severely once their retaliation is verified according to the law. VII. This notice will take effect from the date of publication. Notice from the People’s Government of Hecheng District, Huaihua City on Consolidating and Enhancing the Management of Prohibiting and Restricting Fireworks and Firecrackers in the Main Urban Area of Huaihua (Hezhenghan [2021] No. 15), issued on February 9, 2021, is hereby repealed. According to the Regulations on the Management of Normative Documents of Hunan Province, this notice is valid for five years. In the event of adjustments to national, provincial, or municipal policies during implementation, the new regulations shall prevail.
