Regulations on the Functions, Internal Institutions and Staffing of Huaihua Municipal Bureau of Culture, Tourism, Radio, Television and Sport
Article 1 The Regulations on the Functions, Internal Institutions and Staffing of Huaihua Municipal Bureau of Culture, Tourism, Radio, Television and Sport (“the Regulations” hereinafter) is formulated as per the Notice of the General Office of the CPC Hunan Provincial Committee and General Office of the People’s Government of Hunan Province on Issuing the Huaihua Institutional Reform Plan (X.B. [2018] No. 65).
Article 2 Huaihua Municipal Bureau of Culture, Tourism, Radio, Television and Sport (“the Bureau” hereinafter) is a director-level department of the People’s Government of Huaihua City, which functions as the Huaihua Municipal Cultural Heritage Bureau.
Article 3 The Bureau implements the guidelines, policies, decisions and plans of the CPC Central Committee as well as the plans and requirements of the provincial and municipal Party committees on culture, tourism, radio, television and sport. The Bureau upholds and strengthens the centralized and unified leadership of the Party over culture, tourism, radio, television and sport during its duty performance. Its main responsibilities are as follows:
i. The Bureau shall implement the guidelines, policies, laws and regulations of the Party and the State on culture, tourism, radio, television and sport; formulate plans on the development of culture, tourism, radio, television and sport programs in Huaihua and guide their adoption; guide and promote the innovation of relevant mechanisms and systems in the fields of culture, tourism, radio, television, sport and cultural relics.
ii. The Bureau shall improve public services in culture, tourism, radio, television and sport; plan and guide the production of public cultural products; make overall plan for the allocation of funds for culture, tourism, radio, television and sport programs; and guide the construction of key facilities and community-level facilities for culture, tourism, radio, television and sport.
iii. The Bureau shall draft plans for the development of the culture, tourism, radio, television and sport industry, and guide and coordinate its development. It shall also advance industrial exchanges and cooperation.
iv. The Bureau shall guide cultural and artistic creation and production; manage major cultural activities; give major support to cultural and artistic forms that are representative, exemplary and experimental, as well as characteristic art troupes; and promote the development of all art forms.
v. The Bureau shall guide and manage art and sport programs, as well as the development of libraries, museums, cultural centers (stations), gymnasiums and community-level cultural and sport programs. It shall also guide the operation of non-public culture, tourism, sport and cultural relics institutions, as well as social organizations engaging in culture & art, tourism, sport and cultural relics.
vi. The Bureau shall guide and push forward technological innovation and development in culture, tourism, radio, television, sport and cultural relics, and advance the application of information technology and standards in this industry.
vii. The Bureau shall protect tangible and intangible cultural heritage, and explore, rescue, inherit, publicize and study excellent ethnic culture.
viii. The Bureau shall guide the development of the culture, tourism, radio, television, sport and cultural relics markets, supervise their operation, and advance the establishment of a credit system for the culture, tourism, radio, television, sport and cultural relics industry. It shall also regulate the aforementioned markets in accordance with law.
ix. The Bureau shall organize and guide the development of important tourism products, and promote and guide the use of foreign capital and social investment in tourism. It shall lay down strategies for the development of the international tourism market, and organize tourism image publicity and major promotion activities. It shall also develop, improve and expand the domestic tourism market, formulate measures for market expansion, and guide their implementation.
x. The Bureau shall organize the census, planning, development and protection of tourism resources in Huaihua. It shall guide and coordinate the planning and development of tourist areas, and guide recreation and vacation. It shall monitor tourism economic operation, collect tourism data, and release industry information. It shall also coordinate and guide holiday travel and red tourism.
xi. The Bureau shall regulate the order of the tourism market, supervise and manage service quality, and safeguard the legitimate rights and interests of tourism consumers and operators; standardize the operation and services of tourism enterprises and practitioners; implement the grades and standards of tourist areas (spots), tourism facilities, tourism services and tourism products specified by the State, as well as the star rating, rating standards and rating review of tourist hotels and travel agencies; review and approve the establishment and change of business scope of domestic travel agencies; review and approve travel agencies engaging in overseas tourism business; comprehensively coordinate and regulate tourism safety, and guide emergency rescue; guide the promotion of cultural and ideological progress and establishment of the integrity system in tourism; and strengthen oversight of the tourism market.
xii. The Bureau shall guide tourism education and training; formulate and adopt plans for tourism talents; and guide and implement the professional qualification and grading standards for tourism practitioners. It shall instruct relevant colleges and universities to carry out tourism education work. It shall also undertake the contact work for the establishment of travel clubs and organizations and rule formulation, and give relevant guidance.
xiii. The Bureau shall make overall plans for the development of mass sports; promote the public fitness program; guide mass sports activities; supervise the implementation of national standards on physical exercises; advance the formulation of rules on national physique monitoring and training of social sports instructors; guide the construction of public sports facilities, and regulate such facilities.
xiv. The Bureau shall make overall plans for the development of competitive sports and youth sports. It shall set up sports competition events and put forward the key layout; organize and manage sports training, sports competition and training of sports personnel; step up the training of sports reserve personnel; and promote youth sports.
xv. The Bureau shall make breakthroughs in sports scientific research, apply relevant scientific advances, and organize, coordinate and supervise anti-doping efforts in sports.
xvi. The Bureau shall better radio and television public services; supervise institutions that provide radio, television and information network audio-visual program services as well as their business, and conduct access and exit management; and supervise private institutions that produce radio and television programs.
xvii. The Bureau shall guide and manage the exchanges and cooperation of the culture, tourism, radio, television and sport industry with Hong Kong, Macao, Taiwan and foreign countries, as well as relevant publicity and promotion work.
xviii. The Bureau shall complete other tasks assigned by the Huaihua Municipal Party Committee and People’s Government of Huaihua City.
Article 4 The Bureau has the following internal institutions:
i. Office. It shall be responsible for the operation of the Bureau; organize and coordinate business of the Bureau and its directly affiliated institutions; and urge the implementation of major tasks. It shall also undertake work related to news and publicity, transparency in government affairs, confidentiality, public complaints and proposals, security and patriotic health campaign.
ii. Personnel Education Division (Retirees Management Service Division). It shall formulate and implement plans for personnel training in Huaihua; undertake work related to personnel management, staffing and personnel training of the Bureau and its directly affiliated institutions; and take charge of retiree management services of the Bureau.
iii. Financial Planning Division. It shall manage the budgets, relevant fiscal funds, financial affairs and assets of the Bureau; undertake the internal audit and government procurement of the Bureau and its directly affiliated institutions; and guide and supervise the financial and asset management of institutions directly under the Bureau. It shall undertake industry statistical work, as well as monitoring of the economic operation of tourism. It shall guide the construction of key and community-level culture, tourism, radio, television and sport facilities. It shall also guide and supervise the issuance of sports lotteries.
iv. Industrial Development Division. It shall formulate and adopt plans for the development of the culture, tourism, radio, television and sport industry; guide and facilitate the development of the culture, tourism and sport industry, relevant industrial categories and forms, and the integrated development of the culture, tourism and sport industry and relevant industries; and coordinate the development of cultural industry parks, major projects and bases. It shall conduct scientific research on culture, tourism, radio, television and sport and promote the research achievements. It shall also coordinate the information- and standard-based development of the culture, tourism, radio, television and sport industry.
v. Policies & Regulations Division. It shall formulate and execute the overall plans and policies on culture, tourism, radio, television and sport; adopt and publicize relevant laws, regulations, rules and policies; conduct legality review of regulatory documents; coordinate research efforts on important policies; and write important documents. It shall guide the reform of culture, tourism, radio, television and sport systems and mechanisms. It shall also organize and guide the legal education and training of law enforcement personnel of the culture, tourism, radio, television and sport system; guide and supervise the administrative review, approval and law enforcement in the aforementioned system; and undertake administrative review and response to administrative litigation.
vi. Culture & Art Division. It shall formulate and implement development plans and policies, as well as service standards for cultural public service programs. It shall guide work on mass culture, minority culture, juvenile culture and elderly culture; establishment of libraries, cultural centers and community-level comprehensive cultural service centers; and public digital culture and ancient book conservation. It shall also draft and adopt plans and policies for the development of such cultural and artistic forms as literature, opera, drama, music, dance, acrobatics, fine arts and calligraphy; support cultural and artistic works that embody the core values of socialism, as well as cultural and artistic troupes that represent the municipal standards and characteristics; advance the development of all art types; and coordinate, guide and manage major cultural and artistic activities such as art exhibitions and performance.
vii. Market Management Division (Administrative Review & Approval Service Division). It shall undertake the acceptance, registration and preliminary review of application materials of matters subject to administrative review and approval within the Bureau, as well as payment, production of certificates (documents) and issuance of certificates (documents) for the handling of relevant matters; coordinate administrative review and approval matters related to site investigation, expert demonstration and collective research; undertake administrative review and approval service matters of the Bureau that are handled at Huaihua Government Service Center, as well as the dynamic management of relevant personnel; and take charge of the custody and use of special seals for administrative review and approval of the Bureau. It shall develop and adopt plans for the management of the culture, tourism and sport markets, and conduct industry supervision over market operation. It shall establish a credit system for the culture, tourism and sport industry. It shall have oversight of online cultural premises in urban areas; develop and supervise the implementation of standards for premises, facilities, services and products of the culture, tourism and sport markets; supervise the service quality of the culture, tourism and sport markets; give guidance on improving service quality; step up training on industry service skills; establish star-rated hotels and travel agencies; and regulate the holiday travel market. It shall also comprehensively coordinate security work within the system, as well as industrial security work in Huaihua City.
viii. Resource Development & Integrated Tourism Promotion Division (Red Tourism Guidance Division). It shall formulate and adopt plans and policies for the development of tourism public services. It shall undertake the census, planning, development and protection of cultural and tourism resources. It shall guide and advance integrated tourism, and guide the planning of key tourist areas, destinations and routes, development of rural tourism and recreational tourism, building of the innovation and development system for cultural and tourist products, management of scenic spots, and establishment of A-level tourist attractions. It shall also take charge of red tourism in Huaihua.
ix. Promotion, Communication, Exchange & Cooperation Division. It shall formulate and implement plans and policies on exchanges and cooperation of the culture, tourism, radio, television and sport industry with Hong Kong, Macao, Taiwan and foreign countries, as well as relevant publicity and promotion work. It shall publicize and promote the overall industry image at home and abroad. It shall coordinate and guide affairs related to the exchanges and cooperation of the culture, tourism and sport industry with Hong Kong, Macao, Taiwan and foreign countries, and organize and coordinate cross-regional publicity, promotion, exchange and cooperation activities outside Huaihua City, outside Hunan Province and outside China. It shall coordinate and guide the publicity and promotion of key tourist areas, destinations and routes, and develop and expand the domestic and international tourism markets. It shall also coordinate the cooperation between tourist areas.
x. Radio & Television Division. It shall formulate and adopt plans, policies and service standards for the development of radio and television public services. It shall guide and supervise the publicity of major radio and television themes and activities. It shall regulate the business of TV drama production, distribution and showing institutions. It shall also regulate radio and television broadcasting and transmission institutions; guide and regulate the broadcasting of radio and television advertisements; have oversight of the installation and reception of satellite TV reception facilities and overseas satellite TV programs; formulate and adopt the technological development plans and policies, as well as industry standards for radio, television and new audio-visual media; develop plans for the radio and television transmission coverage network, as well as the monitoring and supervision network; implement the tri-networks integration technical standards; regulate safe radio and television broadcasting and provide technical support; and conduct radio and television quality and technology supervision, monitoring, measurement and detection.
xi. Mass Sports Division. It shall draw up plans for the development of mass sports. It shall enforce the National Fitness Program Outline and Regulations of Hunan Province on National Fitness; adopt the national fitness program; establish and refine the national fitness service system; and carry out and regulate the national fitness program. It shall guide and carry out mass sports. It shall undertake the training of social sports instructors and adopt the social instructor system. It shall organize and launch national physique monitoring activities. It shall guide the implementation of national physical exercise standards. It shall also undertake the skill level management of second-class athletes in mass sports (non-Olympic), training of referees in non-Olympic events and martial art ranking, and management of skill levels.
xii. Competition Training Division. It shall formulate development plans for competitive sports and sports science; plan the layout for sports competition, setup of competitive sports events and key projects; and guide and manage competitive sports training, competitions and youth sports training. It shall apply for and host international or domestic competitive sports competitions held in Huaihua. It shall organize, coordinate and supervise anti-doping work in sports. It shall manage the skill level of athletes and referees in sports competitions and Olympic events confirmed by the General Administration of Sport of China and Sport Bureau of Hunan Province. It shall draft plans for the development of youth sports, and guide the implementation of youth physical exercise standards, as well as the establishment of amateur sports schools, schools specialized in specific sports, sports reserve talent bases and youth sports clubs. It shall also guide and advance the development of school sports; guide and manage youth competition activities, and organize and manage relevant sports meetings; take charge of the registration and management of youth athletes, and on-the-job training of coaches of amateur sports schools; and select and train outstanding athletes for the provincial and national teams.
xiii. Cultural Relics Protection Division (Museum & Social Cultural Relics Division). It shall study the draft policies, regulations and rules for the development of cultural relics programs, and formulate medium- and long-term plans for the development of such programs. It shall develop plans for the allocation of special subsidies for the municipal-level protection of cultural relics; guide the construction and acceptance of municipal cultural relics protection and utilization projects; coordinate and guide the safety protection work of cultural relics and museums (memorial halls); and manage and guide the protection and utilization of cultural relics in a coordinated way. It shall organize work related to designation as major historical and cultural sites protected at the municipal, provincial and national levels. It shall undertake the review of and application for historic cities, towns and villages, as well as world cultural heritage programs. It shall be responsible for the application of protection and utilization projects of major historical and cultural sites protected at the provincial and national levels, and manage their implementation in the whole process; undertake the review and approval of cultural relics protection and utilization projects; organize the survey, design and construction of such projects, and conduct preliminary review of the qualification of the supervision entities as authorized. It shall manage and guide the investigation, exploration, salvage excavation and research of cultural relics in archaeological work and construction projects. It shall manage and guide the establishment and operation of museums (memorial halls) in a coordinated way, and undertake the registration, transfer and exchange of cultural relics collections. It shall also manage scattered cultural relics, and carry out cultural relics appraisal.
Article 7 The Regulations shall be interpreted by the Huaihua Municipal Party Committee and adjusted by the Huaihua Municipal Commission Office of Public Sectors Reform according to prescribed procedures.
Article 8 The Regulations shall take effect upon its issuance.
