    Huaihua Municipal Commerce Bureau

     Article 1 The document is formulated as per the Notice of the General Office of the CPC Hunan Provincial Committee and General Office of the People’s Government of Hunan Province on Issuing the Huaihua Institutional Reform Plan (X.B. [2018] No. 65).

    Article 2 Huaihua Municipal Commerce Bureau (“the Bureau” hereinafter) is a director-level department of the People’s Government of Huaihua City, which also functions as the Office of Port of Entry and Exit of People’s Government of Huaihua City.

    Article 3 The Bureau implements the guidelines, policies, decisions and plans of the CPC Central Committee as well as the plans and requirements of the provincial and municipal Party committees on commercial work. The Bureau upholds and strengthens the centralized and unified leadership of the Party over commercial work during its duty performance. Its main responsibilities are as follows:

    i. The Bureau shall implement national development strategies and policies on domestic and foreign trade, as well as international and regional economic cooperation; draft local regulations, rules, policy measures and implementation measures for domestic and foreign trade, investment promotion, industrial transfer undertaking, foreign assistance, foreign investment and foreign economic cooperation; analyze and advise on the development trend of economic globalization, regional economic cooperation and modern circulation mode, as well as the reform of the circulation system.  

    ii. The Bureau shall advance the restructuring of the circulation industry; guide the reform of circulation enterprises; facilitate the development of the commercial services industry and community commerce; propose policies and suggestions for the development of small and medium commercial enterprises; and step up circulation standardization as well as the development of such modern circulation modes as chain operation, commercial franchise, logistics and distribution, and e-commerce.

    iii. The Bureau shall work out plans for domestic trade development in Huaihua; boost the development of urban and rural markets; propose policies and suggestions to funnel domestic and foreign funds into the development of the market system; guide the planning of the wholesale market for major commodities and urban commercial outlets, as well as the establishment of the commercial system; propel the building of the rural market system; and launch the rural modern circulation network project.

    iv. The Bureau shall take the lead in coordinating, rectifying and regulating the market economic order, and formulate relevant regulation policies; step up commercial credit building, guide commercial credit sales, and establish a public service platform for market integrity; and supervise and manage special circulation industries in accordance with relevant regulations.

    v. The Bureau shall be responsible for the market regulation of important consumer goods and circulation management of important means of production (petroleum products); monitor and analyze market performance and supply and demand of important consumer goods; investigate and analyze their prices, and give forecasts, early-warning and information guidance. It shall undertake the reserve management and market regulation of important consumer goods (meat, tea sold in border areas, food in small package, etc.) according to its responsibilities. It shall also supervise and manage the circulation of petroleum products as required.

    vi. The Bureau shall implement the management measures on import and export commodities and processing trade, as well as catalogs of commodities and technologies subject to import and export management; formulate policies and measures to step up the transformation of the growth mode of foreign trade; adopt the plans on total import and export of important industrial products, raw materials and important agricultural products; coordinate the import and export of major commodities in conjunction with relevant departments; and guide trade promotion activities and the establishment of the foreign trade promotion system.

    vii. The Bureau shall implement national trade policies on foreign technology trade and export control, as well as those supporting the import and export of technologies and complete equipment, and advance the standardization of import and export trade. It shall also supervise technology introduction, equipment import and technologies restricted from export by the State.

    viii. The Bureau shall take the lead in formulating the development plan for trade in services and carry out relevant work. It shall also work with departments concerned to develop and implement plans and policies for promoting service export and outsourcing, and advance the building of the service outsourcing platform.

    ix. The Bureau shall adopt national strategies and policies on multilateral and bilateral (including regions and free trade zones) economic and trade cooperation, and promote the economic and trade exchanges as well as investment and trade cooperation between Huaihua and other countries (regions). It shall also undertake commercial work related to the World Trade Organization and foreign economic and trade coordination.

    x. The Bureau shall organize and coordinate anti-dumping, countervailing and safeguard measures, as well as other work related to fair import and export trade; assist in launching foreign trade and industrial damage investigations; and guide and coordinate industrial safety responses.

    xi. The Bureau shall guide and manage investment attraction, investment promotion and industrial transfer undertaking in Huaihua, and formulate and adopt policies on investment attraction and industrial transfer undertaking; review, approve and file foreign-invested enterprises in Huaihua as authorized; and guide work related to national and provincial economic and technological development zones.

    xii. The Bureau shall formulate and implement foreign economic cooperation policies; manage and oversee the contracting of foreign projects and foreign labor cooperation in accordance with law; develop and implement management policies for the employment of Huaihua people outside China, and take the lead in protecting the rights and interests of expatriate workers and overseas employees; draw up management measures and specific policies for overseas investment, and guide Huaihua enterprises that intend to invest and set up enterprises abroad (except financial enterprises) to submit relevant materials for approval in accordance with the procedures.  

    xiii. The Bureau shall adopt national foreign assistance policies and programs, and coordinate and manage such programs undertaken by Huaihua. It shall also coordinate and manage development and cooperation business such as multilateral and bilateral non-reimbursable assistance and grants to Huaihua (expect grants from foreign governments and international financial organizations under financial cooperation).

    xiv. The Bureau shall implement national economic and trade plans and policies for Hong Kong, Macao and Taiwan; guide trade and economic cooperation between them and Huaihua; and coordinate the management of investment by Hong Kong, Macao and Taiwan businesspersons.

    xv. The Bureau shall promote and manage the MICE industry.

    xvi. The Bureau shall be responsible for the planning, reporting and approval of open ports in Huaihua. It shall also coordinate and manage port work, and push forward with the building of the greater customs clearance mechanism.

    xviii. The Bureau shall supervise and manage production safety in the commercial and trade industry.

    xix. The Bureau shall complete other tasks assigned by the Huaihua Municipal Party Committee and People’s Government of Huaihua City.

    Article 4 The Bureau has the following internal institutions:

    i. Office. It shall be responsible for the operation of the Bureau, as well as work related to confidentiality, public complaints and proposals, security, transparency in government affairs, government affairs information, news and publicity, policy research and comprehensive research.

    ii. Financial Audit Division. It shall be responsible for the use and management of business funds and special funds related to commercial work, prepare and report budgets and final accounts, and announce the budgets; take charge of the financial management, asset management and capital construction of the Bureau, and guide the financial management and asset management of institutions subordinate to the Bureau; undertake the internal audit of the Bureau as well as economic responsibility audit of heads of institutions subordinate to the Bureau, and supervise and audit the state-owned assets and fixed assets of institutions directly under the Bureau.

    iii. Policies, Regulations & Market Order Division. It shall implement national laws, regulations and policies, undertake the legality review of its regulatory documents and work related to the “three unifications” policy, and handle administrative review and litigation related to commercial law enforcement; undertake the training and certificate issuance of law enforcement personnel in the commercial system; handle the proposals of Party representatives, NPC deputies and CPPCC members; advance the improvement of business integrity and development of credit sales and credit service industry; take the lead in cracking down on intellectual property infringement and production and sale of counterfeit and substandard goods, as well as work related to food safety in circulation, promote the building of the traceability system, and guide commercial administrative law enforcement; regulate the transactions of commercial enterprises, and administer domestic direct selling enterprises in cooperation with the Department of Commerce of Hunan Province; undertake the acceptance, registration and preliminary review of application materials of matters subject to administrative review and approval within the Bureau, as well as payment, production of certificates (documents) and issuance of certificates (documents) for the handling of relevant matters.   

    iv. Market Operation & Consumption Promotion Division. It shall formulate policies and measures for market regulation; monitor and analyze the operation, supply and demand of the commodity market, investigate and analyze commodity prize and industry development, and give forecasts, early-warning and information guidance; monitor and analyze the total retail sales of consumer goods in Huaihua; undertake reserve management of important commodities (meat, tea sold in border areas, food in small package, etc.); monitor and analyze the operation of the market for important means of production, and supervise and manage the circulation of petroleum products in accordance with relevant regulations; manage the circulation of cocoon silk according to its responsibilities; coordinate commercial consumption promotion efforts, propose relevant work measures and policy suggestions, and undertake the brand promotion work.  

    v. Market System Building Division. It shall work out policies and measures for the building of the market system and the development of urban and rural markets; guide the planning of urban commercial outlets, as well as the development of the commercial system and community commerce, and advance the building of the rural market system; formulate plans for the major commodities wholesale market, and propel the development of various commodity markets; push forward the building of the agricultural product circulation system and coordination of production and sales; oversee and manage the automobile (including second-hand cars and end-of-life vehicles) circulation industry; and organize and coordinate the construction of major projects of commercial and logistics facilities in Huaihua.

    vi. Division of Trade in Services & Commercial Services Industry. It shall take charge of the development of trade in services in conjunction with relevant departments; undertake the development of service outsourcing, and guide and coordinate the establishment of the service outsourcing platform together with relevant departments; supervise and manage service and technology import & export in accordance with law; and administer and promote the commercial services industry and MICE industry. 

    vii. Division of Circulation Industry Development. It shall work out policies and measures for the development of the circulation industry; undertake work related to circulation standardization and technological progress in the circulation industry; boost the development of chain operation and other modern circulation modes, and manage commercial franchise; establish a public service platform for micro, small and medium circulation enterprises, and manage production safety in the circulation area; facilitate the building of the commercial logistics system and the development of such new business forms as distribution processing and supply chain management; step up brand building, green logistics, recycling of renewable resources, and energy conservation and emission reduction in circulation; oversee and supervise auction, second-hand goods circulation and other special circulation industries as required; and guide safe production within the municipal commercial system.

    viii. Port Division. It shall be responsible for the investigation, demonstration, reporting, approval and acceptance of the opening and closing of ports and places under supervision; undertake port service management and ensure normal port operation; promote the development of the greater customs clearance project; coordinate the planning, development, maintenance and reconstruction of port operation areas and supporting facilities; assist and guide the development of the electronic port customs clearance information platform; and carry out port training and exchange activities related to port business.

    ix. E-Commerce Division. It shall coordinate cross-border and domestic e-commerce work, formulate plans for the development of e-commerce, as well as policies and measures on opening up domestic and foreign markets through e-commerce, and organize their implementation; support the application of e-commerce among small and medium-sized enterprises, and boost the sound development of consumer-oriented e-commerce; advance the building of the e-commerce service system, and set up e-commerce statistics and evaluation systems.

    x. Foreign Trade Division. It shall formulate plans, policies and measures for foreign trade development, and guide the building of the foreign trade promotion system; collect data on the total import and export volume of important industrial products, raw materials and important agricultural products; coordinate and execute plans for participating in international trade fairs and other foreign trade promotion activities held at home and abroad; file and register Huaihua foreign trade operators; work out development plans, policies and measures for the import and export of processing trade, mechanical and electrical products, and high-tech products and give relevant guidance; give guidance on rejuvenating trade through science and technology; and formulate policies and measures to improve the import structure of mechanical and electrical products.

    xi. Investment Management & Foreign Economic Cooperation Division. It shall lay down plans, policies and measures to boost foreign investment, foreign economic cooperation and the development of overseas economic and trade cooperation zones, and guide activities that facilitate foreign investment; file the establishment and change of foreign-invested enterprises as authorized; report substantive changes in the contract articles and special regulations for major foreign-invested projects as authorized; supervise and inspect the implementation of relevant laws, regulations and contracts by foreign-invested enterprises, and take coordinated measures to resolve problems involved; guide the filing and reporting of foreign-invested enterprises, and organize the preparation of their joint annual report; handle and coordinate complaints from foreign-invested enterprises; manage foreign economic cooperation business such as foreign investment, contracting of foreign projects, foreign labor cooperation and design consultation; develop management policies for the employment of Huaihua people outside China, and take the lead in protecting the rights and interests of expatriate workers and overseas employees.

    xii. Personnel Division (Retirees Management Service Division). It shall be responsible for the daily management of officials, civil servants, labor wages, education & training and staffing of the Bureau and its affiliated institutions; formulate and adopt the management system for reviewing and approving economic and trade personnel who intend to go abroad, and record personnel going abroad; undertake work related to the review of professional and technical qualification; and take charge of the management services for retirees of the Bureau.

    xiii. Reform Promotion Division. It shall be mainly responsible for coordinating and addressing the longstanding problems in the restructuring of state-owned commercial and material enterprises which were formerly handled by the Huaihua Municipal Commercial Enterprise Restructuring Office.

    Party Committee. It shall be responsible for work related to the Party and the people in the Bureau and its affiliated institutions.

    Article 5 The Bureau has 31 administrative budgeted posts (including one temporary administrative budgeted post). Specifically, the Bureau has one post for director and three posts for deputy directors (currently four deputy directors on duty), 14 posts for section-level leaders (including one full-time deputy secretary of the Party Committee) (currently 13 section-level leaders on duty), and seven posts for deputy-section-level leaders (currently one deputy-section-level leader on duty).

    Article 6 The establishment, duties and staffing of public institutions under the Bureau shall be otherwise stipulated.

    Article 7 The document shall be interpreted by the Huaihua Municipal Party Committee and adjusted by the Huaihua Municipal Commission Office of Public Sectors Reform according to prescribed procedures.
