    Huaihua Municipal Judicial Bureau

     The main responsibilities of Huaihua Municipal Judicial Bureau (“the Bureau” hereinafter) are as follows:

    1. The Bureau shall investigate and study major issues regarding the law-based governance of Huaihua City on all fronts, coordinate relevant parties to propose medium- and long-term plans and suggestions, and supervise relevant decisions and plans.

    2. The Bureau shall implement national and provincial guidelines, policies, laws and regulations on judicial administration, formulate development plan and annual plan on judicial administration, and supervise their implementation.

    3. The Bureau shall make overall planning for the legislative work of the People's Government of Huaihua City, coordinate relevant parties to give suggestions on legislative planning and annual legislative work plan, and implement the same after obtaining the approval from the People's Government of Huaihua City; track the implementation of the legislative work plan by various departments, step up organization, coordination, supervision and guidance, and propose suggestions and measures to align legislation with reform decisions; and solicit suggestions from the public on items of law and regulation formulation.  

    4. The Bureau shall be responsible for the formulation or organizing the formulation of relevant local laws, regulations and rules; review such laws, regulations and rules; and undertake legislative coordination.

    5. The Bureau shall be responsible for the interpretation and post-legislation evaluation of rules of the People's Government of Huaihua City; address disputes and problems in the implementation of laws, regulations and rules by various regions and departments; and review, compile and file the rules of the People's Government of Huaihua City.

    6. The Bureau shall guide the management of regulatory documents; review the legality of draft regulatory documents of the People's Government of Huaihua City; record the regulatory documents of the People's Government of Huaihua City and its departments; accept the application for investigating the violation of relevant regulatory documents; file and review the regulatory documents of the people's governments of counties and districts; submit the regulatory documents of the People's Government of Huaihua City to the People's Government of Hunan Province and Standing Committee of Huaihua Municipal Party Committee for filing; review the regulatory documents of the government; and review the legality of major administrative decisions made by the People's Government of Huaihua City.

    7. The Bureau shall make coordinated efforts to promote the building of a law-based government; guide and supervise the law-based administration of departments of the municipal people's government as well as the people's governments of counties and districts; comprehensively coordinate the administrative enforcement of laws, promote work related to the reform of the administrative law enforcement system, and advance strict, procedure-based, impartial and non-abusive law enforcement.

    8. The Bureau shall handle cases that request administrative review by the People's Government of Huaihua City, handle or guide relevant departments to handle administrative review matters of cases that request such review by the People's Government of Hunan Province (in which the People's Government of Huaihua City is the respondent), and handle or guide relevant institutions to handle matters concerning response to administrative litigation by the People's Government of Huaihua City; and guide and supervise administrative review and response to administrative litigation across the city.

    9. The Bureau shall be responsible for making overall plans for the building of a law-based society; formulate plans for legal publicity and education, make efforts to increase public knowledge of law, and organize publicity of the rule of law; encourage the people to participate in and promote the rule of law; guide work related to law-based governance and promoting the rule of law, and participate in the comprehensive management of social security; guide the mediation work and the selection and appointment of people's assessor and people's supervisor, and further the establishment of judicial offices.

    10. The Bureau shall guide and manage community correction, and direct the assistance, education and arrangement of emancipists.

    11. The Bureau shall direct and manage compulsory isolation and detoxification as well as drug rehabilitation; and offer guidance, support and assistance in community-based detoxification and rehabilitation.

    12. The Bureau shall formulate the plan for building the public legal service system and guide its implementation, and coordinate and distribute urban, rural and regional legal service resources; guide and supervise the management of lawyers, legal aid, judicial expertise, notarization, arbitration and primary-level legal services.

    13. The Bureau shall be responsible for the organization and implementation of the National Unified Legal Professional Qualification Examination in Huaihua, preliminary review and submission of the application for the legal professional qualification certificate, issuance of the certificate, and management of certificate holders. It shall also plan and guide the pre-employment training of legal professionals and give advice on public legal education.

    14. The Bureau shall be responsible for the international cooperation on the rule of law, promote international exchanges and cooperation in this field, and conduct legal review of foreign-related agreements and other documents of the municipal government.

    15. The Bureau shall manage guns, ammunition, uniform and police cars, and guide and supervise the financial, equipment, facility and venue security work within the system.

    16. The Bureau shall plan, coordinate and guide work related to training of legal personnel; guide and supervise personnel training within the system; undertake police affairs management and supervision; and assist counties and districts in the management of leaders and officials of judicial bureaus.

    17. The Bureau shall complete other tasks assigned by the Huaihua Municipal Party Committee and People's Government of Huaihua City.
